For a petitioner dealing with an uncooperative or absent partner, it provides a definitive path toward closure and independence without being held hostage by another person’s inaction.

However, the primary limitation lies in the potential instability of the final judgment. Because the court decided the case based entirely on one party’s testimony and financial declarations, judges are sometimes willing to reopen a default case later. If the defaulting spouse surfaces months or even a year later and can prove they were never properly served, or that an emergency prevented them from responding, a judge may vacate the default. This forces both parties to start the legal process completely over from scratch.

Additionally, handling custody, child support, and complex property division through a default judgment requires precise legal drafting. A court will not blindly grant unconscionable requests just because the other party is absent.
