According to the California DMV, a license suspension or revocation is separate from any court penalty and generally takes effect 30 days after the order is served, though a timely hearing request can delay it. Also, there is a 10-day limit after receipt of the order during which a driver should ask for a hearing. Failing to meet such a deadline may mean failing to appeal against the suspension.

The Stakes Go Beyond the Courtroom

A guilty plea on DUI charges could lead to fines, probation, license suspension, attendance in classes, and an ignition interlock device, depending on the local laws and circumstances. Public defenders with DUI cases know well the workings of the local court. Individuals who cannot afford a lawyer are generally offered appointed counsel. In fact, the Constitution requires counsel whenever a jail sentence is actually imposed.
